I am not quite sure I understand what it is you're trying to say. Could you clarify? It sounds like you're saying he should take responsibility for someone else giving him a coffee with glass in it.

Well so far as we can tell, OP has not been hurt by the glass, so why should they get something for it? If they saw the glass flying, why didn't they check their coffee?
Quite simply because they would never expect to find glass in there of course. The server didn't expect glass in there either. But everyone has decided this situation has to be someone's fault. I'm pretty sure this isn't the first coffee pot to break at Tim's, but maybe the first to break where the cups are being filled so there wasn't a procedure to deal with it. Or, maybe the person forgot the procedure, they were under pressure to take care of the grumpy lemmings lined up behind the counter waiting for THEIR coffee.

Accidents can be prevented, but at what cost? In case you hadn't noticed, Tim's doesn't exactly hire Harvard grads, and even if they did, they are still human. If Tim's took every precaution to make sure nothing bad ever happened, there would be civil war because a cup of coffee would cost $25.00 due to all the procedures and safeguards in place. Most of the time accidents occur because someone didn't know/understand the potential impact of their actions. This is an incurable trait of humans, and punishing them for it has never solved the problem.

When something happens, and someone says,"I've been wronged, someone has to pay" they forget that we all pay, since the cost is simply passed on. But that doesn't matter because they got their nugget, f**K everyone else.

If you were in your kitchen with your best friend for coffee and dropped the pot and your best friend found glass in their cup, would you volunteer compensation? And would they expect it?

I dislike Tim's, but not as much as I dislike people running around pointing fingers because life is not going along to their plan.

Tort law varies state to state so your generalization is junk.

And when someone slips and falls on ice, that is his or her own fault. I don't think there should be any liability arising out of that, particularly on private residential property. On the other hand, when someone puts a glass shard in your drink, that is NOT the fault of the recipient, it is the fault of the company/person that did it!

Did you think about that?
