So I'm at Oakville Place today and I stopped to grab a coffee. I was next in line when I saw the whole coffee pot burst in the servers hand. Got called up, ordered my coffee and went on my merry way. As I'm shopping and drinking I think nothing of it when I swallow a mouthful of 'sugar'. Carrying on, I get to the bottom of the coffee and hear something clunking in the cup. Took the lid off and lo and behold I see a huge shard of glass at the bottom! I mean like a 2 inch long slice of glass. I took the cup back to timmies and the manager offered me my money back Should I escalate this? I had left my phone in my car and sadly didn't get a picture but do have a witness. Should I bother? |

Completely up to you if you want to sue them. You certainly won't become an overnight millionaire, but 3G in your pocket might be a reality. You have proof that this could have caused you or someone you know serious illness or death. At the very least, write to the higher ups and see what the response is. Ask a lawyer (free consult) for some advice. Tim's response, or no response, will help you decide what to do. The free coffee just doesn't cut it. |

Dont be an opprotunist. This is not the U.S. where everyone sues everyone..consider yourself lucky your not in the emergency. And thank goodness. 26 000 people died today on this planet due to lack of food and water. H |

I wouldn't tread down the lawsuit highway but I would ask for a $100 gift card. A free coffee is a slap in the face. |

I agree with those above suggesting a lawsuit is not appropriate, but I would absolutely escalate the issue with Tim Hortons corporate (as opposed to the specific franchise, who seems to think a refund is OK). This should both improve your compensation, as well as bringing a significant health and safety risk to their attention. Needless to say someone in that Tim Hortons needs to be much more careful and someone on a higher level should know about it. |

You said you swallowed some glass/ surgar possibly. I would be careful if it was glass, this could cause you some serious problems. And yes I would report it to head office and send a letter via email with a photo of the glass in your cup. If you did swallow glass this can turn into a serious issue with in a few days. Hopefully and most likely it will just flush throw your system. But just incase it doesn't, at least you will have a trail, with dates and photo's. I am sure everything will be fine, just keep an eye on anything strange in your system for the next few days. |

I'm totally not trying to get rich quick, just thought that a refund was a slap in the face. I hope the hell it was sugar that I swallowed!! It was gritty so totally could have been sugar, I highly doubt the glass shattered that finely. Still I'd like to bring this to some higher ups |

Again...completely your decision if you decide to sue, but I'm not really sure why everyone on this board is so dead set against it. You really need to talk to a lawyer and consider it. There are a lot of things they could have done in this situation, but didn't. They could have thrown out that pot of coffee and the ones around it (most intelligent solution); they could have warned customers who saw what happened about the broken glass; they could have asked you if you wanted medical attention (should have done). The company doesn't really give a sh*t if you were seriously injured, if you walk away or if you died as a result of what happened. That is the sad part, because they are never held accountable for their actions. They simply do not care. I would talk to a lawyer or read up on how to proceed through small claims court...maybe then Tim's will actually admit that they could have caused you serious harm from a series of mistakes. |

A friend from back in the day had a whole jug of bleach fall on her and quite a bit splashed onto her face and, apparently, in her eyes. Wal Mart gave her $5k. These massive corporations will fight all lawsuits tooth and nail so they don't have to pay out. Getting a lawyer will cost you more than what Timmies will give you, especially if you go down the "we get paid when you get paid" lawyer path. And it could be a few years before you'd see a dime. Write a letter to their head office and see what happens. |

I say you should contact head office and see what they can do (and keep your phone on you at all times If it makes you feel any better, I go to the Starbucks at the Metro Plaza some mornings, and I get the impression from the cashiers that they hate me (i.e. not friendly, don't say thanks, don't wish me a nice day, but they do to other patrons) because I only order a grande Pike Place Coffee ($2.26 tax in), pay with exact change, and decline on their breakfast up-sells vs. buying a $6 latte or saying yes to an overpriced breakfast. |

You will never win a lawsuit, Canada has some laws around this and you need to have some serious injuries before you can sue. I do think you need to take this higher in the corporate food chain though |

Sounds like they don't have appropriate staff training to handle these type of situations. Don't feel bad about suing them. It's probably the only way to force the company to train the staff better. |
