So glad I'm only a moderator here & not Rick who has the pleasure of receiving these types of letters.

Not surprised people are taking legal action.

Isn't it the moderator's job (yes I know they're just volunteers, but whatev) to make sure rules are followed? These types of letters would be avoided if the rules were being applied.

Damn that lawyer is looking for blood! He wants Rick to delete the post and also the detailed info of the people that attacked his client so he can go after them. The last paragraph says he's coming after us too. If Rick doesnt release our info to the guy, Rick will be issued a court order to give up our identities. Well not all of us, whoever was attacking the guy. Looks like the orginal post in question was started in January by someone with the username that starts with "m". What post was it? I want to know if I joined in on the bashing and may be sued lol

If all the rules were applied strictly it wouldn't be much of a forum. For instance your wanting to punch people in the neck could be considered very threatening. As a moderator I do the best I can but I try to concentrate most of the time on my biggest pet peeves which are spam and businesses that advertise without following the rules.

Rick, I hope you have the stones to create a new stick ( those things I hate, but for this it would be worth it ) where you post all cease and desist letters -- I can't imagine they can sue you for posting their letters. Remove the 'offending' post, but it would be nice to know what businesses can't accept legitimate intarweb feedback.

I agree, if they are lawyering up I imagine it's because there is truth to the complaint. Otherwise they would argue their case here and shut it down just like sign guy vs car dealership.

I say remove the offending comments from the offending threads to cover your ass from nuisance suits, but, in their place post the unredacted legal letters for people to see.

Also, I would hope that you don't provide the poster information to anyone who asks for it like the lawyer does in that letter. But if you do I have a list of members I would like info on.

I doubt the lawyer is going to pursue it further than asking for removal of the post. Lawyers always talk hard in their letters to scare you and never follow through. If the post is gone, nothing will come out of it. You can even post smack again, they just ask you to remove it again. And the cycle continues.

Sure, but in order to go to court to fight the request its probably going to cost Rick $10,000. Its not going to get to that trust me. He's going away once the post is removed.

I was just saying that there was no need to roll over on the request from the lawyer because it's essentially meaningless.
